This bilingual document is presented in English first, followed by the Arabic version (النسخة العربية تلي النسخة الإنجليزية). Both versions are intended to carry the same meaning. For users in the Kingdom of Saudi Arabia, the Arabic version governs; for users elsewhere, the English version governs. These Terms of Use and End-User License Agreement ("Terms", "Agreement", or "EULA") form a binding agreement between you ("you", "User") and the independent developer of the Nibrasi application (نبراسي) ("we", "us", "our", or the "Developer"), a sole proprietorship based in the United Arab Emirates. They govern your access to and use of the Nibrasi mobile application, its features, and any related content or services (together, the "Service").
By downloading, installing, accessing, or using the Service — including by tapping "Agree", "Continue", or any equivalent control — you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not install or use the Service.
These Terms are concluded solely between you and the Developer, and not with Apple Inc. ("Apple"). Apple is not responsible for the Service or its content (see Section 17).
Note: The 13+ figure above must match the age rating computed by the App Store Connect rating questionnaire and the Privacy Policy. If a generative-AI/unrestricted-content questionnaire result raises the App Store rating, this clause and the Privacy Policy will be updated to the same figure.
Nibrasi is an independent study tool.

Nibrasi is not affiliated with, authorized by, certified by, sponsored by, or endorsed by the Education and Training Evaluation Commission (ETEC), the National Center for Assessment (Qiyas / قياس), or any government, examination, or accreditation body. References to the General Aptitude Test ("GAT"), "Qudrat" (قدرات), "Tahsili" (تحصيلي), "Qiyas" (قياس), or similar terms are used only descriptively to identify the subject matter that Nibrasi helps you study. Such references do not imply any official status, partnership, approval, or accreditation. All third-party names and marks remain the property of their respective owners.
We make no claim that the Service is "certified", "approved", or "officially recognized", and we make no guarantee of any examination score, result, ranking, admission, or outcome.
The Service uses third-party artificial-intelligence ("AI") providers to deliver core features, namely:

a) AI consent. Before the first time any of your content — whether typed by you or read from a photo — is sent to a third-party AI provider, the Service asks for your explicit consent. You may decline, but the AI-dependent features will then be unavailable. The specific providers are identified by name in this Section and in our Privacy Policy.
b) AI may be inaccurate — verify.
AI-generated explanations may be inaccurate or incomplete — verify before relying on them. This is a practice tool and is not a substitute for a qualified teacher or official ETEC/Qiyas preparation materials.
AI-generated content is produced automatically and may contain errors, omissions, outdated information, or content that is incomplete or unsuitable for your specific needs. You must independently verify any solution, explanation, or answer before relying on it. The Service does not provide professional, educational, legal, or other expert advice, and it is not a replacement for a qualified teacher, tutor, or official study materials.
c) Persistent AI notice. The Service displays an ongoing notice that you are interacting with AI-generated content.
d) Scope. Nibrasi is a scoped study assistant. Its AI features are intended to address aptitude/exam-preparation topics. The Service may filter, refuse, or limit requests that fall outside this scope or that violate Section 8 (Acceptable Use).
e) Content you submit. Photographs you capture for solving are processed in memory and are not stored on our servers. We do not use your submitted content to train AI models, and we instruct our AI providers not to retain or train on it, configuring provider settings (e.g., no-training / zero-data-retention options where offered) to that end. Your solve history (text of questions and generated solutions) is stored privately and associated with your account or anonymous identifier, as described in our Privacy Policy.
Nibrasi exists to help you learn and understand (تعلّم وافهم). You agree to use the Service honestly and ethically. In particular, you must not:
You are solely responsible for complying with the rules of any examination or institution. Misuse of the Service for cheating is a serious violation of these Terms and may result in immediate termination of your access. We disclaim all responsibility for any consequences arising from your dishonest or non-compliant use.
The Service offers a free tier and paid options:
The exact subscription title, billing period, and price are presented in the App Store and on the in-app purchase screen before you buy.
a) Merchant of record. All purchases are processed by Apple through your Apple Account. Apple is the merchant of record, including for KSA VAT and other applicable taxes Apple collects. We do not collect or process your payment-card details. Prices are shown in the App Store and include applicable taxes where Apple collects them.
b) Auto-renewal of subscriptions. Auto-renewing subscriptions renew automatically at the end of each billing period (e.g., monthly or annually) at the then-current price, unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours prior to the end of the current period. The subscription continues until cancelled.
c) Managing and cancelling. You can manage or cancel a subscription, and turn off auto-renewal, at any time in your device Settings → [your name] → Subscriptions (or via the App Store). Cancellation takes effect at the end of the current paid period; you retain access until then. Deleting the app does not cancel a subscription.
d) Free trials. If a free trial is offered, any unused portion is forfeited when you purchase a subscription. If you do not cancel before the trial ends, the subscription begins and the applicable fee is charged.
e) Refunds. All sales are final and we do not provide refunds directly. Refund requests are handled solely by Apple under the Apple Media Services Terms and Conditions, at Apple's discretion and subject to applicable law. To request a refund, use Apple's "Report a Problem" process (reportaproblem.apple.com). Nothing here limits any non-waivable statutory right you may have under applicable consumer-protection law.
f) Price changes. We may change prices and the contents of any plan. For auto-renewing subscriptions, material price increases are handled in accordance with Apple's rules, which may require your consent before the increased price takes effect.
You agree not to, and not to permit others to:
We may monitor for abuse and may suspend or terminate access for violations.
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use one copy of the Service on Apple-branded devices that you own or control, solely for your personal, non-commercial study purposes, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. This is a license, not a sale. We reserve all rights not expressly granted.
The Service, including its software, design, user interface, original practice questions, flashcards, curated explanations, text, graphics, audio, the Nibrasi name, logo, and all related content (collectively, "Our Content"), is owned by the Developer or its licensors and is protected by intellectual-property laws. Except for the limited license in Section 9, no rights are transferred to you.
You may not scrape, copy, reproduce, distribute, publicly display, create derivative works from, sell, or otherwise exploit Our Content without our prior written permission. Original practice questions and flashcards are created by us and provided for your personal study only; their bulk extraction or redistribution is prohibited.
Your feedback. If you send us suggestions or feedback, you grant us a perpetual, royalty-free, worldwide license to use it without obligation to you.
The Service relies on third-party providers (including cloud hosting and the AI providers named in Section 4). Your use of those features may be subject to the providers' own terms. We are not responsible for third-party services, their availability, or content they generate. Names of examinations and third-party marks are used descriptively only (see Section 3).
Your use of the Service is also governed by our Privacy Policy (nibrasi.app/privacy), which describes what data we process, identifies the AI providers by name (Anthropic, ElevenLabs), explains anonymous-identifier handling and the guardian-consent mechanism, and sets out your rights. Data is stored with our processor Supabase in Frankfurt, Germany (EU); AI processing occurs primarily in the United States.
You acknowledge that, because the Service supports examinations administered in Saudi Arabia and is offered to users connected to the Kingdom, the Saudi Personal Data Protection Law (PDPL) may apply on an extraterritorial basis. Where it applies, we honor PDPL requirements, including data-subject rights (access, correction, deletion), controlled cross-border data transfer, breach-notification obligations (including notification to SDAIA within seventy-two (72) hours of becoming aware of a qualifying breach, as required by the PDPL and its implementing regulations), and additional protections for minors. We also act consistently with applicable UAE data-protection law. See the Privacy Policy for how to exercise your rights.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL CONTENT (INCLUDING AI-GENERATED CONTENT) ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.
We do not warrant that any solution, explanation, or answer is accurate, complete, or suitable, that the Service will meet your requirements, or that it will improve any examination result. Some jurisdictions do not allow certain warranty exclusions; in that case, the exclusions apply to the maximum extent permitted, and you may have additional non-waivable rights.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (such as for fraud, or death or personal injury caused by negligence). Some jurisdictions do not allow certain limitations; in that case the limitations apply to the maximum extent permitted.
To the extent permitted by law, you agree to indemnify and hold harmless the Developer from any claims, damages, liabilities, and reasonable expenses (including legal fees) arising out of your misuse of the Service, your violation of these Terms, your use of the Service to cheat or breach an examination/institution rule, or your violation of any law or third-party right.
We may suspend or terminate your access at any time, with or without notice, if you breach these Terms or if we discontinue the Service. You may stop using the Service and delete the app at any time. Sections that by their nature should survive termination (including Sections 3, 5, 10, 13, 14, 15, 18, and 19) survive. Termination does not entitle you to a refund except as provided by Apple (Section 7e).
You acknowledge and agree that:
These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-laws principles, and you agree to the exclusive jurisdiction of the competent courts of the UAE, except that (a) mandatory consumer-protection or data-protection laws of your country of residence (including the Saudi PDPL where applicable) continue to apply where they grant you greater protection, and (b) any dispute relating to App Store purchases may also be subject to the Apple Media Services Terms and Conditions. Nothing in this Section deprives you of the protection of mandatory provisions of the law of your habitual residence. For language of interpretation, see the note at the top (Arabic governs for KSA users; English governs elsewhere).
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, provide notice in the app. Your continued use of the Service after changes take effect constitutes acceptance. If you do not agree to the updated Terms, you must stop using the Service.

تُشكّل شروط الاستخدام واتفاقية ترخيص المستخدم النهائي هذه ("الشروط" أو "الاتفاقية" أو "اتفاقية الترخيص") اتفاقية مُلزِمة بينك ("أنت" أو "المستخدم") وبين المطوّر المستقل لتطبيق نبراسي ("نحن" أو "المطوّر")، وهو مؤسسة فردية مقرّها دولة الإمارات العربية المتحدة. وتحكم هذه الشروط وصولك إلى تطبيق نبراسي وميزاته وأي محتوى أو خدمات ذات صلة واستخدامك لها (يُشار إليها مجتمعةً بـ "الخدمة").
بتنزيلك الخدمة أو تثبيتها أو الوصول إليها أو استخدامها — بما في ذلك الضغط على "أوافق" أو "متابعة" أو أي زر مماثل — فإنك تؤكد أنك قرأت هذه الشروط وفهمتها وتوافق على الالتزام بها وبسياسة الخصوصية الخاصة بنا، المُدرَجة هنا بالإحالة. إذا كنت لا توافق، فلا تُثبّت الخدمة ولا تستخدمها.
تُبرَم هذه الشروط حصراً بينك وبين المطوّر، وليست مع شركة Apple Inc. ("آبل"). وآبل ليست مسؤولة عن الخدمة أو محتواها (انظر القسم ١٧).
ملاحظة: يجب أن يطابق الرقم ١٣+ أعلاه التصنيف العمري الذي يحتسبه استبيان التصنيف في App Store Connect وسياسة الخصوصية. وإذا رفعت نتيجة استبيان الذكاء الاصطناعي التوليدي/المحتوى غير المقيّد تصنيف المتجر، فسيُحدَّث هذا البند وسياسة الخصوصية إلى الرقم ذاته.

أداة دراسة مستقلة. غير تابعة لهيئة تقويم التعليم والتدريب (ETEC) أو المركز الوطني للقياس (قياس) ولا معتمدة منهما.
نبراسي غير تابع لـ هيئة تقويم التعليم والتدريب (ETEC) أو المركز الوطني للقياس (قياس) أو أي جهة حكومية أو اختبارية أو اعتمادية، وغير مُصرّح به أو معتمَد أو مدعوم أو مُقرّ من أيٍّ منها. والإشارات إلى اختبار القدرات العامة ("GAT") أو "قدرات" أو "تحصيلي" أو "قياس" أو ما شابهها تُستخدَم وصفياً فقط للتعريف بالموضوع الذي يساعدك نبراسي على دراسته. ولا تعني هذه الإشارات أي صفة رسمية أو شراكة أو موافقة أو اعتماد. وتظل جميع الأسماء والعلامات الخاصة بأطراف ثالثة ملكاً لأصحابها.
نحن لا ندّعي أن الخدمة "معتمدة" أو "مُقرّة" أو "معترف بها رسمياً"، ولا نقدّم أي ضمان بشأن أي درجة أو نتيجة أو ترتيب أو قبول في أي اختبار.
تستخدم الخدمة مزوّدي ذكاء اصطناعي ("AI") من أطراف ثالثة لتقديم ميزاتها الأساسية، وهم تحديداً:
*(مزوّد لتحويل الكلام إلى نص للإدخال الصوتي محجوز لنسخة مستقبلية ولا يُستخدم في هذه النسخة؛ وإذا أُدخل، فسيُسمّى ويُضاف إلى طلب الموافقة ويُفصح عنه في سياسة الخصوصية قبل إرسال أي صوت.)*
أ) الموافقة على الذكاء الاصطناعي. قبل أول مرة يُرسَل فيها أي محتوى خاص بك — سواء كتبته أنت أو قُرئ من صورة — إلى مزوّد ذكاء اصطناعي خارجي، تطلب الخدمة موافقتك الصريحة. ويمكنك الرفض، لكن الميزات المعتمدة على الذكاء الاصطناعي لن تكون متاحة عندئذٍ. والمزوّدون المحدّدون مذكورون بالاسم في هذا القسم وفي سياسة الخصوصية.
ب) قد يكون الذكاء الاصطناعي غير دقيق — تحقّق.
قد تكون الشروحات المُولَّدة بالذكاء الاصطناعي غير دقيقة أو غير مكتملة — تحقّق منها قبل الاعتماد عليها. هذه أداة تدريب وليست بديلاً عن معلّم مؤهَّل أو عن مواد قياس/ETEC الرسمية للإعداد.
يُنتَج المحتوى المُولَّد بالذكاء الاصطناعي تلقائياً وقد يحتوي على أخطاء أو إغفالات أو معلومات قديمة أو محتوى ناقص أو غير مناسب لاحتياجك. يجب عليك التحقّق بشكل مستقل من أي حل أو شرح أو إجابة قبل الاعتماد عليه. ولا تقدّم الخدمة استشارة مهنية أو تعليمية أو قانونية أو خبيرة، وهي ليست بديلاً عن معلّم أو مدرّس مؤهّل أو المواد الدراسية الرسمية.
ج) إشعار دائم بالذكاء الاصطناعي. تعرض الخدمة إشعاراً مستمراً بأنك تتفاعل مع محتوى مُولَّد بالذكاء الاصطناعي.
د) النطاق. نبراسي مساعد دراسي محدود النطاق. وميزاته الذكية مخصّصة لمواضيع القدرات والإعداد للاختبارات. ويجوز للخدمة تصفية الطلبات الخارجة عن هذا النطاق أو المخالِفة للقسم ٨ (الاستخدام المقبول) أو رفضها أو تقييدها.
هـ) المحتوى الذي ترسله. تُعالَج الصور التي تلتقطها للحل في الذاكرة ولا تُخزَّن على خوادمنا. ولا نستخدم المحتوى الذي ترسله لتدريب نماذج الذكاء الاصطناعي، ونوجّه مزوّدي الذكاء الاصطناعي لدينا بعدم الاحتفاظ به أو استخدامه للتدريب، ونضبط إعدادات المزوّد (مثل خيارات عدم التدريب / عدم الاحتفاظ بالبيانات حيثما تتوفّر) لتحقيق ذلك. أما سجلّ حلولك (نصوص الأسئلة والحلول المُولَّدة) فيُخزَّن بشكل خاص ويُربط بحسابك أو معرّفك المجهول، كما هو موضّح في سياسة الخصوصية.
وُجد نبراسي لمساعدتك على التعلّم والفهم (تعلّم وافهم). وتوافق على استخدام الخدمة بأمانة وأخلاقية. وعلى وجه الخصوص، يجب ألّا:
أنت وحدك المسؤول عن الالتزام بقواعد أي اختبار أو مؤسسة. وإساءة استخدام الخدمة للغش انتهاك جسيم لهذه الشروط وقد يؤدي إلى إنهاء وصولك فوراً. ونحن نُخلي مسؤوليتنا عن أي عواقب تنشأ عن استخدامك غير النزيه أو غير المتوافق.
تقدّم الخدمة فئة مجانية وخيارات مدفوعة:
يُعرَض اسم الاشتراك الدقيق ومدة الفوترة والسعر في App Store وفي شاشة الشراء داخل التطبيق قبل أن تشتري.
أ) تاجر التسجيل. تُعالَج جميع المشتريات عبر آبل من خلال حساب آبل الخاص بك. وآبل هي تاجر التسجيل (merchant of record)، بما يشمل ضريبة القيمة المضافة في المملكة العربية السعودية وغيرها من الضرائب المطبّقة التي تحصّلها آبل. نحن لا نجمع تفاصيل بطاقتك البنكية ولا نعالجها. وتظهر الأسعار في App Store وتشمل الضرائب المطبّقة حيثما تحصّلها آبل.
ب) التجديد التلقائي للاشتراكات. تتجدّد الاشتراكات المتجدّدة تلقائياً عند نهاية كل دورة فوترة (مثلاً شهرياً أو سنوياً) بالسعر الساري حينها، ما لم تُلغِ قبل ٢٤ ساعة على الأقل من نهاية الدورة الحالية. ويُخصَم مبلغ التجديد من حساب آبل خلال ٢٤ ساعة قبل نهاية الدورة الحالية. ويستمر الاشتراك حتى يُلغى.
ج) الإدارة والإلغاء. يمكنك إدارة الاشتراك أو إلغاؤه وإيقاف التجديد التلقائي في أي وقت من الإعدادات ← [اسمك] ← الاشتراكات (أو عبر App Store). ويسري الإلغاء عند نهاية الدورة المدفوعة الحالية؛ وتحتفظ بالوصول حتى ذلك الحين. وحذف التطبيق لا يُلغي الاشتراك.
د) التجارب المجانية. إذا قُدّمت تجربة مجانية، فإن أي جزء غير مستخدَم منها يُفقَد عند شراء اشتراك. وإذا لم تُلغِ قبل انتهاء التجربة، يبدأ الاشتراك ويُحصّل الرسم المطبّق.
هـ) الاسترداد. جميع المبيعات نهائية ولا نقدّم استرداداً مباشرةً. تُعالَج طلبات الاسترداد حصراً عبر آبل بموجب شروط وأحكام خدمات Apple Media، وفق تقدير آبل ورهناً بالقانون المطبّق. ولطلب استرداد، استخدم خدمة "الإبلاغ عن مشكلة" من آبل (reportaproblem.apple.com). ولا يحدّ أي مما ورد هنا من أي حق قانوني غير قابل للتنازل قد يكون لك بموجب قوانين حماية المستهلك المطبّقة.
و) تغييرات الأسعار. يجوز لنا تغيير الأسعار ومحتويات أي باقة. وبالنسبة للاشتراكات المتجدّدة، تُعالَج الزيادات السعرية الجوهرية وفق قواعد آبل، التي قد تتطلّب موافقتك قبل سريان السعر المرتفع.
توافق على ألّا تقوم، وألّا تسمح لغيرك بالقيام، بما يلي:
يجوز لنا رصد إساءة الاستخدام وقد نعلّق الوصول أو نُنهيه عند المخالفات.
رهناً بالتزامك بهذه الشروط، نمنحك ترخيصاً محدوداً وشخصياً وغير حصري وغير قابل للتحويل أو الترخيص من الباطن وقابلاً للإلغاء لتنزيل نسخة واحدة من الخدمة واستخدامها على أجهزة من علامة آبل تملكها أو تتحكّم بها، حصراً لأغراض دراستك الشخصية غير التجارية، وفق قواعد الاستخدام في شروط وأحكام خدمات Apple Media. وهذا ترخيص وليس بيعاً. ونحتفظ بجميع الحقوق غير الممنوحة صراحةً.
الخدمة، بما في ذلك برمجياتها وتصميمها وواجهتها وأسئلتها التدريبية الأصلية وبطاقاتها التعليمية وشروحاتها المنسّقة ونصوصها ورسوماتها وصوتها واسم نبراسي وشعاره وكل المحتوى ذي الصلة (يُشار إليها مجتمعةً بـ "محتوانا")، مملوكة للمطوّر أو مرخّصيه ومحمية بقوانين الملكية الفكرية. وباستثناء الترخيص المحدود في القسم ٩، لا تُنقَل إليك أي حقوق.
لا يجوز لك كشط محتوانا أو نسخه أو إعادة إنتاجه أو توزيعه أو عرضه علناً أو اشتقاق أعمال منه أو بيعه أو استغلاله بأي شكل دون إذن خطّي مسبق منا. والأسئلة التدريبية والبطاقات الأصلية من إنتاجنا وتُقدَّم لدراستك الشخصية فقط؛ ويُحظَر استخراجها بالجملة أو إعادة توزيعها.
ملاحظاتك. إذا أرسلت إلينا اقتراحات أو ملاحظات، فإنك تمنحنا ترخيصاً دائماً وخالياً من الإتاوات وعالمياً لاستخدامها دون التزام تجاهك.
تعتمد الخدمة على مزوّدين من أطراف ثالثة (منهم مزوّدو الاستضافة السحابية ومزوّدو الذكاء الاصطناعي المذكورون في القسم ٤). وقد يخضع استخدامك لتلك الميزات لشروط هؤلاء المزوّدين. ولسنا مسؤولين عن خدمات الأطراف الثالثة أو توافرها أو المحتوى الذي تولّده. وأسماء الاختبارات وعلامات الأطراف الثالثة تُستخدَم وصفياً فقط (انظر القسم ٣).
يخضع استخدامك للخدمة أيضاً لـ سياسة الخصوصية (nibrasi.app/privacy)، التي توضّح البيانات التي نعالجها، وتُسمّي مزوّدي الذكاء الاصطناعي بالاسم (Anthropic وElevenLabs)، وتشرح التعامل مع المعرّف المجهول وآلية موافقة ولي الأمر، وتبيّن حقوقك. وتُخزَّن البيانات لدى معالجنا Supabase في فرانكفورت بألمانيا (الاتحاد الأوروبي)؛ وتجري معالجة الذكاء الاصطناعي بشكل أساسي في الولايات المتحدة.
تُقرّ بأنه نظراً لأن الخدمة تدعم اختبارات تُدار في المملكة العربية السعودية وتُقدَّم لمستخدمين مرتبطين بالمملكة، فقد يُطبَّق نظام حماية البيانات الشخصية السعودي (PDPL) على أساس خارج الحدود الإقليمية. وحيثما يُطبَّق، فإننا نلتزم بمتطلباته، بما في ذلك حقوق صاحب البيانات (الوصول والتصحيح والحذف)، ونقل البيانات عبر الحدود بشكل منضبط، والتزامات الإخطار عن خرق البيانات (بما في ذلك إخطار الهيئة السعودية للبيانات والذكاء الاصطناعي "سدايا" خلال اثنتين وسبعين (٧٢) ساعة من العلم بخرقٍ مؤهِّل، وفق نظام حماية البيانات الشخصية ولائحته التنفيذية)، وحماية إضافية للقُصّر. كما نتصرّف بما يتوافق مع قانون حماية البيانات المطبّق في الإمارات. راجع سياسة الخصوصية لكيفية ممارسة حقوقك.
إلى أقصى حد يسمح به القانون المطبّق، تُقدَّم الخدمة وجميع المحتوى (بما في ذلك المحتوى المُولَّد بالذكاء الاصطناعي) "كما هي" و"حسب توافرها"، دون أي ضمانات صريحة أو ضمنية، بما في ذلك ضمانات القابلية للتسويق أو الملاءمة لغرض معيّن أو الدقة أو عدم الانتهاك أو التشغيل دون انقطاع أو خطأ.
نحن لا نضمن دقة أو اكتمال أو ملاءمة أي حل أو شرح أو إجابة، ولا أن الخدمة ستلبّي متطلباتك، ولا أنها ستحسّن أي نتيجة اختبار. وبعض الولايات القضائية لا تسمح بهذه الاستثناءات؛ وفي تلك الحالة تُطبَّق الاستثناءات إلى أقصى حد مسموح، وقد تكون لك حقوق إضافية غير قابلة للتنازل.
إلى أقصى حد يسمح به القانون المطبّق:
لا يستثني أي مما ورد في هذه الشروط أو يحدّ من المسؤولية التي لا يمكن استثناؤها أو تحديدها بموجب القانون المطبّق (كالاحتيال أو الوفاة أو الإصابة الشخصية الناجمة عن الإهمال). وبعض الولايات القضائية لا تسمح بهذه القيود؛ وفي تلك الحالة تُطبَّق إلى أقصى حد مسموح.
إلى الحد الذي يسمح به القانون، توافق على تعويض المطوّر وحمايته من أي مطالبات أو أضرار أو التزامات ومصروفات معقولة (بما في ذلك أتعاب المحاماة) تنشأ عن إساءة استخدامك للخدمة، أو مخالفتك لهذه الشروط، أو استخدامك الخدمة للغش أو لمخالفة قواعد اختبار/مؤسسة، أو مخالفتك لأي قانون أو حق طرف ثالث.
يجوز لنا تعليق وصولك أو إنهاؤه في أي وقت، بإشعار أو دونه، إذا خالفت هذه الشروط أو إذا أوقفنا الخدمة. ويمكنك التوقف عن استخدام الخدمة وحذف التطبيق في أي وقت. وتظل الأقسام التي تبقى بطبيعتها سارية بعد الإنهاء (بما في ذلك الأقسام ٣ و٥ و١٠ و١٣ و١٤ و١٥ و١٨ و١٩) نافذة. ولا يمنحك الإنهاء حق الاسترداد إلا وفق ما تتيحه آبل (القسم ٧-هـ).
تُقرّ وتوافق على ما يلي:
تخضع هذه الشروط لقوانين دولة الإمارات العربية المتحدة، دون اعتبار لمبادئ تنازع القوانين، وتوافق على الاختصاص الحصري للمحاكم المختصة في الإمارات، باستثناء أن (أ) قوانين حماية المستهلك أو حماية البيانات الإلزامية في بلد إقامتك (بما في ذلك نظام PDPL السعودي حيثما يُطبَّق) تظل سارية حيث تمنحك حماية أكبر، و(ب) أي نزاع يتعلّق بمشتريات App Store قد يخضع أيضاً لشروط وأحكام خدمات Apple Media. ولا يحرمك أي مما ورد في هذا القسم من حماية الأحكام الإلزامية لقانون محل إقامتك المعتاد. ولِلُغة التفسير، انظر الملاحظة في الأعلى (العربية تحكم لمستخدمي المملكة، والإنجليزية تحكم لغيرهم).
يجوز لنا تحديث هذه الشروط من وقت لآخر. وعند إجراء تغييرات جوهرية، سنحدّث تاريخ "آخر تحديث" ونقدّم إشعاراً داخل التطبيق عند الاقتضاء. ويُعدّ استمرارك في استخدام الخدمة بعد سريان التغييرات قبولاً لها. وإذا كنت لا توافق على الشروط المحدَّثة، فيجب أن تتوقف عن استخدام الخدمة.
